Frontier Tutoring Event Drawing

(the “Program”)

The Program is open only to legal residents of the United States who are eighteen (18) years of age or older. Residents of New York, Florida, and Rhode Island are not eligible to participate. Only individuals who have signed up for a drawing created and run by North Star Tutors, Inc and/or its subsidiaries (collectively the “Company”) and completed all steps required for entry for the particular drawing, as publicized by the company on materials pertaining to the specific drawing, are eligible to win. Eligibility to participate in the Program is void wherever prohibited or restricted by law. Duplicate or more entries are disqualified and voided. The Company reserves the right to deny and disqualify any submission without notice to the individual who has entered, if the Company in its sole discretion believes that the entry violates some component of these Terms and Conditions.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE A DRAWING UNDER THE PROGRAM. Purchasing services from the Company will not improve your chances of winning.

The odds of winning depend on the number of eligible entries for a particular drawing under the Program. The Company will draw one (1) winner from each drawing for which the Company holds a Program signup. The winner will receive a prize of 4 hours of free Academic Tutoring services. The Company, in its sole discretion, may also choose to draw multiple winners, or provide additional prizes (each, also, a “Prize”). A Prize cannot be utilized towards any other services offered by the Company including, but not limited to, SAT or ACT prep, College Admissions Counseling, or music lessons. Failure of the individual to legibly and correctly provide their information on a given Program signup form, or failure to complete the required steps for a particular drawing is not the responsibility of the Company and the Company shall maintain no obligation to honor a Prize if the individual cannot be contacted. The receipt of a Prize is not combinable with any other offers, discounts, or pricing adjustments under any Company program, including, but not limited to, the First Lesson Free policy. A Prize is non-exchangeable, non-transferable, and is not redeemable for cash or any other prizes, except where required by law. Availability of instruction in any specific subject is not guaranteed and the Company makes no representation that a particular subject will be available to a winner at the time they receive a Prize. Additional terms and requirements may exist for a given drawing under the Program. Any terms and requirements listed on publicized materials for a given drawing are hereby incorporated into these terms as they pertain to that drawing.

To the maximum extend allowed by law, the Company retains the right to modify these Terms and Conditions of the Program at any time without notice to any beneficiaries under the Program, so long as the Company maintains any existing obligations to which it has agreed under these Terms and Conditions. The Company further reserves the right in its sole discretion to cancel or modify any drawing under the Program if the specific drawing’s integrity is compromised in any way, and it may select winners from eligible non-suspect entrants. All federal, state and local laws and regulations apply.

The drawings will take place at the Company’s office, within 30 days of the conclusion date of drawing from which the entries were collected, and the winners will be announced through the Company Facebook page at https://www.facebook.com/frontiertutoring. The winner will also be contacted at the phone number and email address provided on their entry. The winners will be selected by or under the supervision of the Company, in its sole discretion, in random drawings from all eligible entries. The Company is not responsible for any technical difficulties, or other challenges that may prevent a winner from being able to collect a Prize.

By entering the Program, you agree that if you are selected as a winner the Company may release and publish your name without restriction on their social media pages, website, and/or in any other format which the company feels is appropriate, including upon request to participants of the Program or event hosts, or as otherwise legally required. A winner may be required to sign and return an affidavit of eligibility, or the Prize may be forfeited. A winner must, to accept a Prize, accept the terms and conditions for receiving services from the Company (the “Service Terms”). If a winner does not agree to be bound by the Service Terms, the Prize may be forfeited. The winners may be requested to sign an additional publicity release; however, execution of a publicity release is not required to accept a prize. If a winner executes a publicity release, the winner agrees, where lawful, that the Company may use the winner’s name, likeness, biographical information, voice, and statements attributed to winner (if true) for publication, advertising and promotional purposes, without consideration. The Company will collect personal data about all entrants in accordance with its privacy policy. Please review the Company’s privacy policy here. By participating in the Program, you agree to the Company’s collection and usage of your personal information and you acknowledge that you have read and accepted the Company’s privacy policy. The Company will further maintain your information digitally and may contact you, including but not limited to. by email, phone call, and/or text message (standard SMS/data rates may apply). These communications may include promotions, offers, company updates, sales attempts, and/or marketing materials. By entering into a drawing under the Program, you hereby consent to the above electronic communications from the Company. Any participant can withdraw this consent at any time by clicking “unsubscribe” at the bottom of any list email received from the Company, or by replying “stop” to a company text message.

By entering the Program, you fully and unconditionally agree to be bound by these Terms and Conditions and the decisions of the Company, which will be final and binding in all matters relating to the Program. Failure to comply with these Terms and Conditions may result in disqualification from the Program. The Company reserves the right to verify the eligibility of entrants and to disqualify permanently from the Program any entrant it believes has violated these Terms and Conditions.

By participating in the drawings, you agree to release, discharge, and hold harmless the Company, and its parents, employees, directors, affiliates, subsidiaries, advertising and promotional agencies and their respective members, officers, directors, employees and agents, from any liability, claims, losses, and damages arising out of or relating to this Program, including without limitation your participation in the event at which the Company collected your registration.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the entrants and the Company in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of Delaware, without regard to its conflict of law provisions, except as to matters relating to arbitration, which shall be governed by the Federal Arbitration Act. Any dispute arising out of or relating to the drawings or any prize will be decided only by informal negotiation followed by arbitration, individually and not on a class-wide basis. Any arbitration will be administered by the American Arbitration Association and will take place in Fairbanks, Alaska. Any and all claims or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the drawings, but in no event attorney’s fees; and under no circumstances will an entrant be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

The Company shall not be liable for any failure to comply with its obligations under the Program where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
